Disclaimers & Legal Clarifications

All trials for HUT-designated offenses shall be scheduled promptly (within 72 hours) with full adherence to the legal standards set forth in this Code.

Any individual who unlawfully escapes custody shall be presumed guilty of all other charges pending against them, and such individual may not assert separate defenses for those charges.

Probation or bail may be considered in non-capital cases unless the crime poses an imminent threat to public safety. In such cases, bail shall be set at 1.5 times the maximum fine as determined by the court.

No counsel shall be permitted within jail cells during the period of incarceration.

Law enforcement and judicial authorities shall enforce these codes with fairness and without prejudice.

Notwithstanding an offense’s initial classification as a non-criminal infraction, any failure to comply with a clear and lawful order (for example, an order to vacate a public area when wearing an unauthorized face covering as defined under PC.6.04) may result in the offense being escalated to a criminal charge. Such escalation shall occur when noncompliance poses a demonstrable threat to public order or safety, as evidenced by documented instances of refusal to comply with the lawful directive.

No individual shall be charged with harassment solely for speaking with or expressing grievances to an on-duty public servant. Such communication, in and of itself, is considered a lawful exercise of free speech and a right to seek redress. However, if the interaction escalates, characterized by abusive language, overt threats, or actions that hinder the public servant’s ability to perform their duties, then harassment charges (as defined under PC.5.05) may be pursued.

This Penal Code is binding upon all citizens of Rosewood Ridge County and shall be administered with justice, integrity, and respect for the law. Every individual is expected to abide by these statutes under the full authority of the Rosewood County legal system.
